Someone must act on your behalf to carry out your personal and financial affairs if you lose capacity as a result of an accident or disease such as a stroke or dementia. Your bank accounts will be stopped if you lose legal capacity to make decisions for yourself. Bills cannot be paid, and pensions or benefits cannot be accessed, causing a great deal of distress for friends and family.
A Lasting Power of Attorney (LPA) is a legal document that allows you to choose someone to manage your affairs if you are unable to do it yourself.
There are two forms of LPA: one that allows you to pick who can make financial decisions for you (LPA Property & Finance) and another that allows you to choose who can make personal, medical, or care decisions for you (LPA Personal, Medical, and Care) (LPA Health & Welfare).
Obtaining a Lasting Power of Attorney (LPA) when a person has lost mental capacity can be challenging, if not impossible. If this is the case, more expensive choices should be considered. A Deputyship Order, as opposed to an LPA, is one of these possibilities. It is more expensive and has more restrictions. We always advise establishing a Lasting Power of Attorney as soon as possible to ensure that your affairs are handled by the person you choose rather than the courts. It also means you won’t have to pay a lot of money in legal fees.
